    The Supreme Court will hear today petitions seeking to cancel the NEET-UG 2024 test held on May 5 over alleged paper leak and malpractices..

    A bench comprising Chief Justice of India DY Chandrachud, Justices JB Pardiwala and Manoj Misra will hear the matter post 10.30 AM. The NEET matters are listed as items 5 to 9.

    The Central Government and the National Testing Agency have opposed the demand for re-test by stating that the malpractices are localised and have not affected the sanctity of the entire exam. The Centre cited a data analytics report prepared by IIT Madras to argue that there was no systemic failure as the report did not indicate any "mass malpractice".

    During the hearing held on July 8, the bench led by CJI DY Chandrachud sought the responses of the Union/NTA on the extent of the paper leak and possible segregation of the wrongdoers from others. The Court said that if the sanctity of the entire exam has been affected and it was impossible to separate the beneficiaries of fraud from the honest candidates, then a re-test may be necessary. The Court also said that the re-test would be the last option, considering the impact on nearly 24 lakh students.

      CJI : What is the distance between Patna and Hazaribagh?

      SG : It is at a distance. One gang member, who was at Hazaribagh, sent it by WhatsApp. Their model is not to allow the students to take photographs. The parents have given post-dated cheques over and above advance. If the leak gets widespread, exam will get cancelled,they know. So they ask students to keep out their mobile phones.

      SG : The total number of such students will not cross 150.

      SG : Students got only 2 hours to memorise the questions. That is why only out of 18 students, only one student is possibly getting admission, but he will face debarment.

      SG : 7.30.

      CJI : What time does it reach centre?

      SG : 7.45

      CJI : The whole hypotheses that entire paper was solved in 45 minutes and given to students is too far fetched.

      SG : One hour.

      CJI : Okay, even one hour, seem far fetched.

      CJI : Assuming that happens, according to you that students got papers at 10.15 AM. There are 180 questions. Is it possible that between 9.30 and 10.15 that there are problem solvers and putting them to students in 45 minutes?

      SG : There were 7 solvers and they divided 25 students each. The questions were jumbled and so students were made to memorize.

      CJI : According to you when the leak took place?

      SG : There is no leak which took place.

      CJI : Okay, when the breach took place?

      SG : It was in a particular centre, between 8.02 AM to 9.23 AM a person goes in, photographs the paper and comes out

      CJI : There are two possibilities. One the paper gets leaked before the custody of banks. That means, it happened before May 3. Second, the leak happened when the papers left the banks and are bound for the centre.

      CJI : Alternative hypothesis that leak happened in custody of banks is possible according to you, which means May 3. Between May 3 and May 5 is a long interval..

      CJI : According to them, students were made to memorize on May 5 morning. That means prior to 5th May somebody has solved the question papers. If somebody has solved the papers, it has happened prior to May 5. So the leak happened prior to May 4th night. Question is when the leak happened.

      Hooda : In the counter-affidavit, they say it is not a certified copy of 161 statement and hence should be discarded from the evidence.

      SG says that the translation of the statement is not accurate.
