The Supreme Court will hear today petitions seeking to cancel the NEET-UG 2024 test held on May 5 over alleged paper leak and malpractices..

A bench comprising Chief Justice of India DY Chandrachud, Justices JB Pardiwala and Manoj Misra will hear the matter post 10.30 AM. The NEET matters are listed as items 5 to 9.

The Central Government and the National Testing Agency have opposed the demand for re-test by stating that the malpractices are localised and have not affected the sanctity of the entire exam. The Centre cited a data analytics report prepared by IIT Madras to argue that there was no systemic failure as the report did not indicate any "mass malpractice".

During the hearing held on July 8, the bench led by CJI DY Chandrachud sought the responses of the Union/NTA on the extent of the paper leak and possible segregation of the wrongdoers from others. The Court said that if the sanctity of the entire exam has been affected and it was impossible to separate the beneficiaries of fraud from the honest candidates, then a re-test may be necessary. The Court also said that the re-test would be the last option, considering the impact on nearly 24 lakh students.

CJI : How is the breach linked to Patna?

SG : A gang member was there in Patna.

SG : Gang ensured that they purchased a new mobile with new SIM so that there is no further leak..

CJI : 45 minutes whole question paper can be solved?

    • 18 July 2024 3:50 PM IST

Hooda : The story which the NTA gives that the paper was collected at Hazaribagh and during the transport the breach happened..

CJI : That is not their case. Is it your case SG?

SG : Breach occurred in Hazaribagh school. Patna breach is linked to Hazaribagh

    • 18 July 2024 3:47 PM IST

CJI : Then we are only left with the statistics....can we cancel the entire examination on that sole basis?

Hooda says the conspiracy was hatched a month ago.

    • 18 July 2024 3:44 PM IST

CJI : Mr.Hooda, Godhra, we cannot say it was a part of widespread malpractice...firstly, there is no evidence that the cheating took place, and we can place it at the same level as Patna or Hazaribag

    • 18 July 2024 3:43 PM IST

Hooda : Possibility cannot be ruled out that Tushar Bhatt had the solved question papers.

    • 18 July 2024 3:43 PM IST

CJI : Mr.Hooda, even Godhra seems a localised issue. Nothing went through in the sense before it happened they were caught.

Hooda : The paper footprint does not confine to Patna, it travelled.

CJI : In Godhra, students had no opportunity. There is no wrongdoing eventually. The process was that the centre-in charge will fill in the blanks and not that they memorize. But that was prevented ultimately.

    • 18 July 2024 3:41 PM IST

CJI : Godhra has nothing to do with paper leak per se.

CJI : In Godhra, 2 centres, 2513 candidates. How many come within the last candidates?

NTA : About 18. Their performance is also below average.

CJI : How many students at Godhra had changed their centres?

NTA : 14 were allowed change of centres.

SG : Out of that 14, nobody is getting admission.

    • 18 July 2024 3:38 PM IST

SG : Nobody (from Godhra) is getting admission.

CJI : Because it did not fructify..

SG : Tushar Bhatt told students that he will ask Physics and Chemistry teachers to fill up the OMR sheets..

CJI : He was the in-charge of the centre.

SG : This information came to the knowledge of District Magistrate

    • 18 July 2024 3:38 PM IST

CJI : Mr.Hooda, tell us, is there any material, we understand your limitations too, to indicate that similar method was replicated outside Hazaribagh and Patna?

      SG : No.

Hooda : In Godhra, it was agreed that the Geogrpahy lecturer Tushar Bhatt will fill the blank OMR sheets. Common sense says a geography teacher cannot solve it unless he has the paper leaked.

CJI : But in Godhra they were arrested before.

    • 18 July 2024 3:35 PM IST

CJI : What is worrying us is, how much was the period between the breach occurred and the exam? If the time period is 3 days, obviously there is a greater danger.

Does somebody pay 75,000 for 45 minutes?
