The Supreme Court will hear today petitions seeking to cancel the NEET-UG 2024 test held on May 5 over alleged paper leak and malpractices..

A bench comprising Chief Justice of India DY Chandrachud, Justices JB Pardiwala and Manoj Misra will hear the matter post 10.30 AM. The NEET matters are listed as items 5 to 9.

The Central Government and the National Testing Agency have opposed the demand for re-test by stating that the malpractices are localised and have not affected the sanctity of the entire exam. The Centre cited a data analytics report prepared by IIT Madras to argue that there was no systemic failure as the report did not indicate any "mass malpractice".

During the hearing held on July 8, the bench led by CJI DY Chandrachud sought the responses of the Union/NTA on the extent of the paper leak and possible segregation of the wrongdoers from others. The Court said that if the sanctity of the entire exam has been affected and it was impossible to separate the beneficiaries of fraud from the honest candidates, then a re-test may be necessary. The Court also said that the re-test would be the last option, considering the impact on nearly 24 lakh students.

Hooda : Telegram videos indicate that on 4th May, the question papers were circulating. It was the original question papers. The time is 9 AM. The NTA wants this Court to disbelieve. The date and time they show is not a date and time which can appear in a Telegram channel. It is a watermark. It is not a date and time. Date and time appears like the one which is appearing in page (in the petitioners' submission).

Hooda : NTA does not talk about this in the written note filed yesterday.

CJI : Idea of somebody doing this is not to make a national charade of NEET exam. People were doing it for money. Therefore anybody who is making money out of it won't circulate it mass scale.

    • 18 July 2024 2:46 PM IST

Hooda : Given the nature of social media, it is impossible to accurately determine the exact spread of the leaked papers and the beneficiaries.

    • 18 July 2024 2:44 PM IST

Hooda says there are photographs of e-rickshaw carrying the papers and the Principal of the school was arrested for part of the leak. He was part of the NTA and city coordinator, Hooda says.

Hooda : Dissemination of the leaked paper was happening on the May 3 itself. Evidence of Telegram videos show that the solved papers were being circulated on May 4 itself.
