    Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheswari and CT Ravikumar will hear the matter today.

    Senior Advocate Kapil Sibal will continue his arguments today on behalf of Zakia Jafri.

    On Tuesday, the Supreme Court heard the closing arguments of the Solicitor General, Mr. Tushar Mehta. At the outset, the Solicitor General was critical of the motivations of Teesta Setalvad (Petitioner No. 2) in the present proceedings, which he argued was to simply malign the State of Gujarat. Apart from that, Mr. Solicitor General, vehemently argued that the State had taken all measures that it possibly could, after the Sabarmati Express was torched and during the ensuing riots. To substantiate his claim, he relied on the Report of the Commission of Enquiries set up by the State with respect to the 2002 riots. In his rebuttal, Mr. Kapil Sibal fervently reiterated his submissions on the lack of investigation by SIT.

      Sibal: I am not concerned with 27.02.2002. But my contention on larger conspiracy stands which emanates from many documents.

      Sibal: I am not saying conspiracy happened because of 27.02.2002.

      Bench: Your theory goes back to building up of event. We have noted that.

      Sibal: The case is of larger conspiracy but not related to 27.02.2002. I did not contend disputed facts.

      Sibal: The Petitioner did not contend that larger conspiracy emanated from meeting of 27.02.2002 alone. The undisputed evidence demonstrate a larger conspiracy (with respect of Tehelka tapes etc.). It is this conspiracy which is not investigated by SIT. That is my statement.

      Mr. Sibal informed the Bench that he would place on record a statement w.r.t. larger conspiracy.

      Sibal: It is a statement of the petitioner qua larger conspiracy. The Petitioner has not sought to allege any wrong doing with reference to facts which are disputed.

      Sibal: Only one instance where SIT recorded statement of witness was that of Shivanand Jha and exonerated them(police). Those who support police officer you take only their statement. With this kind of evidence, SIT cannot be given ‘good conduct’ in the role of an investigator.

      Sibal:The argument was that she was just a widow so we(SIT)were helping her. I think the SC was not passing order to merely help a widow. Then NHRC, Citizens Tribunal, Teesta will come and fight for them. The State is monolith these days. Ordinary citizens cannot fight the State.

      Sibal: When J. Bhagawati started PIL, in situations where people who are marginalised, if the offences against them or authorities are not dealing with them consistent with law, court will take it up though PIL.

      Sibal: Deployment of army. If all this nothing happened before 1, there was no occasion for Central Govt. to do this (deploy army at 2). KPS Gill was sent in May, because even then situation was volatile. SIT did not record his statement.
