Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

On Wednesday, Mr. Mukul Rohatgi, appearing on behalf of SIT, emphatically submitted that the SIT had conducted an impeccable investigation and on certain occasions went beyond their means to meet the ends of justice. Over a course of seven days, a Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar had heard the detailed submissions of Senior Advocate Kapil Sibal demonstrating the failure of SIT in investigating the matter.

Rohatgi: SIT examined everybody from the CM downwards - major people in cabinet, top police officials, top civil administrative officers, arrest of Maya Kodnani, enquiry against Tandon. CM going to some place or not - How is it related to SIT investigation.

Rohatgi: Then the allegation, the CM did not visit the riots affected areas though he visited Godhra on the day of the incident.

Rohatgi: Material of Nanavati is also brought here (allegations). They say, this was said in Nanavati, so SIT should also examine.

      Bench: Justice Nanavati also examined?

Rohatgi: The Commission examined all three star witnesses and commented adversely.

Rohatgi: para 14, lackadaisical grant of bail. So, the allegation is that all these cases were State sponsored. These are irresponsible statements.

    • 25 Nov 2021 11:47 AM IST

Rohatgi: See, the impact of this line. What do you mean by state sponsored? It would mean State turned against its people. Do they understand the import of this statement?

    • 25 Nov 2021 11:47 AM IST

Rohatgi: Kindly see the actual allegation w.r.t. Best Bakery and Bilkis. Some of the glaring examples of state sponsored event.

    • 25 Nov 2021 11:47 AM IST

Bench: This is not an allegation, actually this is fact. Those cases were of which year?

Rohatgi: Same year. Nothing to do with any of the 9 cases. They were two independent caes, which were ghastly otherwise.

    • 25 Nov 2021 11:47 AM IST

Rohatgi: See allegation no.9 - indictment of SC in respect to Best bakery and Bilkis Bano. This does not include in 9 cases. This was not given to SIT, still it goes into it to do its job.

    • 25 Nov 2021 11:46 AM IST

Rohatgi: This (reading the statement of Shreekumar and others) is not a case for examining a conspiracy or any criminality. The officer says that I informed the Govt, no action taken. What is this to do with examining further material with respect to Gulberg?

    • 25 Nov 2021 11:36 AM IST

Rohatgi: They (SIT) had taken their job more seriously than they should have, if you ask me.
