    The Supreme Court will hold a special Sunday sitting today to hear a contempt petition against the closure of Metro stations and the cancellation of trains during anti-CEC protests yesterday.

    The Court will also hear a habeas petition filed by Sr Adv Menaka Guruswamy against the detention of political leaders.

      Gopal S: It should come from that side also, how to behave with peaceful protestors

      J Bagchi to SG: We are dutybound under Art 32 to prevent encroachment on fundamental rights. All matters including unlisted petitions and applications will be tagged with the main matters on Tuesday.

      Counsel: Let them release digital devices. They havent detained person, they have seized phones. They contain [sensitive] information.

      J Bagchi: We have heard.

      BREAKING Supreme Court orders no illegal detention takes place of those peacefully gathering.

      Court orders Metro & Rail Services to function normally, Internet facilities must remain undisturbed as per law and free movement of people and traffic be permitted.

      Order: Mr Mehta has on instructions submitted that the internet facilities in the city has since been restored and all metro stations and trains are fully functional. He also assures that lawyers, journalists and other professionals shall not be impeded in discharge of professional duties. Taking note, we direct -

      (i) Metro and rail facilities shall function normally until and unless regulations required to be imposed keeping in mind disturbance to public order as under Art. 19(2)

      (ii) Free movement of people in the city shall be permitted subject to traffic regulations. Imposition of barricades shall be reviewed forthwith keeping in mind law and order and other traffic conditions.

      (iii). Internet facilities shall remain undisturbed (J Bagchi- we are not taking away powers under IT Act)

      (iv) Smooth movement of people in the city shall be permitted in accordance with law.

      (v) There shall not be detention save and except by procedure established by law, particularly with respect to assemblage of peaceful, unarmed people beyond the area where S.163 BNSS is in operation.

      On S.163 around SC: We direct authority to take down the board if not already done, so that there is no apprehension with regard to access to justice (including ingress/egress) to any court of law

      BREAKING | Supreme Court orders Metro & Rail Services to function normally and that Internet facilities must remain undisturbed as per law.

      Court also directs that free movement of people and traffic be permitted and that requirement of barricades be reviewed.

      Order: we direct the authorities to submit a short affidavit showing cause why contempt proceedings should not be initiated

      SG: Your lordships may issue notice instead of saying show cause

      Order: Issue notice on alleged contemnors to file an affidavit in response to the contempt petition and also submit a compliance report in terms of the order as aforesaid. the other unlisted petitions shall be served on office of SG in the course of day. They shall be tagged with present contempt proceeding and writ petition

      Gopal S: I had served both copies on Mr Mehta.

      Order: Counsels have also strongly pleaded for ad-interim reliefs with regard to smooth operation of metro rail, traffic, internet services and free movement of people, especially lawyers, journalists and professionals.

      Order: With regard to the allegations, Mr Mehta orally denies and disputes. He contends that the Delhi Metro was functioning normally, however some entry points had been closed. (45 out of 303 stations had been closed). With regard to anxious concern expressed that the essential services remain suspended, he assured this court that all stations of metro railway are open since 10 pm yesterday, trains are functioning normally and internet connection is restored. With regard to a serious insinuation that S.163 BNSS has been camped in and around Supreme Court premises, Mr Mehta sought time to take instructions.

      Gopal S: It has to be listed immediately.

      JBagchi: All govt installations have S.163 imposed, but they are not enforced

      Sr Adv PV Dinesh: 163 is imposed, I was infront of court.

      J Bagchi: We will take care of it.

      Order: In summary, the authorities concerned had been directed to revisit the earlier notification issued by DMRC of closure of 57 railway stations keeping in mind that metro operations and other railway services may be regulated but not prohibited in approprite cases. The order had also directed the authorities to publish the reconsidered decision. Thirdly, the order had directed fresh traffic advisories in respect of free movement of vehicles. Order also called for compliance affidavit by authorities.

      Order - Oral mentionings were made in respect of diary no...wherein similar prayers had been made. In addition thereto, Dr Guruswamy took us through pleadings in the list matter, wherein it has been averred that metro railway stations namely GTB Nagar and Vishwavidyalaya and others were completely shut out to public and there has been a deliberate and willful violation of the order. In the habeas corpus petition, Dr Guruswamy forcibly contended that prayer in re:illegal detention is not restricted to personalities pleaded therein, but is a plea for widespread illegal detention of alleged 7000 individuals in the city. Other counsels have contended that fundamental freedoms must be exercised in a responsible manner and are subject to reasonable restrictions. Mr SG, assisted with [...], contends that the petitions which were mentioned orally have not been served on the Union and accordingly they are unable to assist the court on the issue.

      J Bagchi: We will keep on tuesday. give interim response. We had already passed order.

      Order: In view of the urgent applications alleging violation of our earlier order dt. 9.10.2026 and also alleging illegal detention of large no. of individuals at Delhi on 10.10.2026, this court had assembled for an urgent hearing. Sr counsels/counsels submitted there was flagrant violation of the directions, metro railway was not functioning, new delhi and nizamuddin railway stations remained closed, no traffic advisories were issued and large no. of persons were subjected to undue harassment and illegal detention even beyond the area which was covered by the prohibitory order under S.163 BNSS. It was also contended that there was complete shutdown of internet and city bore a curfew like situation with suspension of transport and free movement of people and goods.
