Supreme Court will continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

During the course of 3 days before today, Mr. Sibal took the bench through the documents to demonstrate the failure of the SIT in investigating the matter and the flaw in SIT's stand that there was no violence or arson. SIT has not challenged the Gujarat High Court's decision to acquit Maya Kodnani, former BJP MLA from Naroda, who was identified as the 'kingpin' in the Naroda Patiya massacre of 2002 by the trial court, Mr. Kapil Sibal argued hinting at the political optics of the SIT not challenging the High Court order. Senior Advocate Kapil Sibal told the Supreme Court that the SIT head RK Raghavan was appointed as a High Commissioner later, and all these people who 'collaborated were rehabilitated later.

Senior Advocate Kapil Sibal is arguing for the petitioner, Zakia Jafri, widow of Congress MLA Ehsan Jafri who was killed in the Gulberg Housing Society massacre during the 2002 Gujarat Riots. She approached the Supreme Court through a special leave petition challenging the SIT report which ruled out any "larger conspiracy" by high state functionaries in instigating the communal riots following the Godhra massacre.

Bench: Mr. Sibal you have made a point that the script has not been looked at in closure report, HC or Mag. We do not have to read it like that. Only if other side points out that this has been considered then we can see.

    • 16 Nov 2021 10:00 AM GMT

Sibal: I am not saying this is proved. But, why was the investigation not done. Now that is the SIT for your lordship. There is another part of Haresh Bhat's testimony.

Sibal: [reads transcript] I owned a gun factory.. used to make firecrackers, we made all the bombs there, used to supply there. We got two truckloads of swords from Punjab.

    • 16 Nov 2021 9:53 AM GMT

Sibal: [Reads from transcript: How could you get (bomb) when curfew was imposed. I got them from MP, Bihar...Only swords were brought?.. we made (rocket) launchers filled with gun powders. Was it used everywhere? In Ahmedabad? Yes, I am talking about Ahmedabad]

    • 16 Nov 2021 9:53 AM GMT

Sibal: Then to pg 401. Milords I want to clarify that the entire transcripts are more than what we have given. We have culled out the relevant one. We will give the page in the note correlating to the transcript.

    • 16 Nov 2021 9:52 AM GMT

Sibal: Testimony not relied upon. This man was never arrested, never investigated. Then there is the transcript of Haresh Bhat, Vol VB. From pg 381 a summary - [handpicking of PPs and defence advocates; police did not stop use of bombs and smuggling of arms]

    • 16 Nov 2021 9:46 AM GMT

Sibal: Kindly note that this was 27th afternoon. Bodies have not reached Ahmedabad.

Mr Sibal reads the note in the transcript which states Dhawal instructs his men in Gujarati to get bomb-making material and explains the procedure.

    • 16 Nov 2021 9:43 AM GMT

Sibal: [Transcript stated Police stood by...supported the mob]. Why this ommission by SIT? Why was this man not arrest? Because obviously he needed protection.

    • 16 Nov 2021 9:42 AM GMT

Sibal: Your Lordships will see that this was not referred to by the prosecution, SIT or Mag. Why did SIT not rely upon this? This refers to conspiracy. You are sending bombs all across. This is a larger conspiracy.

    • 16 Nov 2021 9:39 AM GMT

Sibal: Actually there is no heading. I have added it in my document for convenience. Your Lordships will take Volume VA. Kindly come to the (Tehelka) transcript of Dhawal Patel.
