Bench dictating the order : The matter came up before this Court on 17.5.2021 against the HC order rejecting the bail and directing the Petitioner to approach trial Court.

Bench dictating the order: By the said order, the HC had directed the examination of Petitioner by hospital in Guntur and had listed the matter for 16.5.2021. Pursuant thereto, a medical report was submitted on 16.5.2021.

Bench dictating the order : The impugned order was passed by the HC. It is noteworthy that one the same day, pursuant to a letter, the HC passed another order after treating said letter as habeas corpus petition.

Bench dictating the order :The Magistrate by order dated 15.5.2021 required the Petitioner to be produced before Medical Board and be examined. He asked for a medical report from government as well as examination from private hospital.

Bench dictating the order :  The submission is that the Petitioner has been arrested on 14.5.2021 and he has been tortured in police custody of which mention has been made by the Magistrate at the stage of remand.

Bench dictating the order : According to the Counsel, the Section has been included to make the offences non-bailable.

Bench dictating the order :According to Petitioner, the statements made by the Petitioner are mere criticism of actions of State and in no case can the statements be classified as sedition and punishable under 124A.

Bench dictating the order : Rohatgi submits that the MP was critical of CM and in that connection the FIR was filed. It was submitted that ruling party has grudge against Petitioner.

Bench dictating order : It was in this connection that this petition for bail was filed before the HC which has been dismissed. Challenging the said order, the instant plea has been filed.

Order: After inquiry by CID and on the directions of the ADG of CID to institute an FIR in said inquiry report. The FIR was lodged on 14.5.2021 with the following allegations.
