    The Supreme Court will hear today the Delhi Air Pollution matter. A bench comprising Justice Abhay S Oka and Justice Augustine George Masih will hear the matter at 3.30 PM (MC Mehta v. Union of India).

    On Monday, the Court had observed that it would allow the relaxation of GRAP-4 restrictions only after seeing a consistent downward trend in the Air Quality Index (AQI). The Court had also summoned the Chief Secretaries of the NCR States to appear virtually over the default in paying subsistence allowance to labourers who are unemployed due to the ban on construction activities. Further, the Court took serious exception to the Delhi Police not ensuring the safety of Advocates who were deputed as Court Commissioners to check the ban on entry of trucks to Delhi.

      Amicus Aparajita Singh: I strongly disagree with ASG that we cannot improve further than this. It emphasizing the problem of implementation. Ground level reality of GRAP IV we have to see. Many things are just on paper. Open garbage burning still happening in Delhi in Mundka. We may get out of GRAP IV but the commission must coordinate and ensure the activities are implemented.

      Bhati: today we are proposing that lordships allow us to operate the GRAP schedule as per the AQI levels. So today we are out of the GRAP schedule. The forecast for the next week suggests that we will not go beyond stage 2.

      Bhati: It is a wide range of fluctuations in the AQI level. Court may look at how Delhi air behaves during November and December. Our geography and our meteorological conditions do not permit up to aspire to be in the European country status.

      J Oka: Now to the Commission. What is your stand?

      ASG Aishwarya Bhati: there is a clear downward trend but it is thanks to the meteorological conditions. As of yesterday's reading we are out of the GRAP.

      Order: Delhi government to immediately convene the meeting of unions of the construction workers and appeal to them to instruct The eligible workers to register themselves on the portal.

      Details of payment per worker in Rajasthan to be placed on record on the next date in the directions to Delhi will also be applied to Rajasthan and Haryana. Apart from the steps directed in case of Delhi government UP government to ensure that all eligible workers are paid the money immediately.

      Counsel for Haryana: Portal is open and it is an ongoing process.

      For UP Court is told that 97 Crores have been allotted for labourers. And 8046 workers have been paid out of 488246 workers.

      Counsel: the process is going on.

      Counsel: Rest we will pay in 1 or 2 days. We have also appointed additional labour inspector.

      For Haryana Court is told that there are 257000 workers out of which 106000 workers have been paid. Message has gone to all the workers.

      J Oka: who is for Rajasthan government now? How many workers are there and how many have you paid?

      Counsel: There are 2 district in NCR region. 3526 workers. 2063 workers have been paid. Tota amount is 7659000 Rs

      Counsel: there are 1200000 workers enrolled with the Board whose registrations have lapsed. The registration process is very cumbersome and now they have made it digital which makes it even more difficult for the workers.

      CS: These are the ones registered on the portal.

      J Oka: have you made any effort to find out whether there are any other construction workers.

      CS: we have been informing the unions.
