    The Supreme Court will hear today the Delhi Air Pollution matter. A bench comprising Justice Abhay S Oka and Justice Augustine George Masih will hear the matter at 3.30 PM (MC Mehta v. Union of India).

    On Monday, the Court had observed that it would allow the relaxation of GRAP-4 restrictions only after seeing a consistent downward trend in the Air Quality Index (AQI). The Court had also summoned the Chief Secretaries of the NCR States to appear virtually over the default in paying subsistence allowance to labourers who are unemployed due to the ban on construction activities. Further, the Court took serious exception to the Delhi Police not ensuring the safety of Advocates who were deputed as Court Commissioners to check the ban on entry of trucks to Delhi.

      Order: the appointment of court commissioners are to continue so long as GRAP measures are enforced and they're free to submit reports to this court in terms of earlier orders. All orders passed earlier regarding giving them protection will continue to operate.

      Order: we are informed that while issuing show cause notices to those who have violated GRAP norms the Delhi Pollution control Committee has named the court commissioners appointed by the court. None of the authorities who are taking action for violation of GRAP norms shall incorporate the names of Court Commissioners.

      Bhati: we have made a team of all those who were responsible for that and we are getting action taken reports. we will submit within a week's time.

      Order: Considering the scope of this petition we leave it to the learned amicus to give her suggestion so that we can appoint few other members of the bar as amicus. She is free to give her suggestions by sending email so that appropriate orders can be passed.

      Order: While we permit the commission to do so we must record here that if the commission finds that AQI goes above 350 as a precautionary measure Stage 3 measures will have to be immediately implemented.

      If AQI goes above 400 on a given day, stage 4 will measures will have to be introduced.

      Order: Further monitoring on the part of this court is necessary. We permit the commission to go to stage two for the present. It will be appropriate if the commission may consider incorporating certain additional measures which are part of stage 3.

      Order: now we deal with the question of Graded Response Action Plan. Learned ASG has tendered across the bar a brief note prepared by the Commission. Her submission is that even stage one of GRAP will not apply. Her submission is that in view of improvement in the situation that applicability of GRAP Action Plan be left to the commission. We have the figures of AQI from 18th November till 4th December up to 30th November. The levels are consistently above 300 and it is only during last 4 days that the levels have come down below 300. It is true that at some stage the court will have to leave it to the commission to decide about the applicability of stages under GRAP. Considering the data placed before us we do not think that it will be appropriate at this stage to allow Commission to go below stage 2.

      J Oka: there has to be a protocol for garbage burning and farm fires in Delhi Take help from ISRO. 2016 rules are not being implemented. We want to see how there is so much variance in areas of Delhi.
