Calcutta High Court is hearing the CBI's case against the bail granted to TMC leaders Firhad Hakim, Madan Mitra, Subrata Mukherjee and Souvan Chatterjee in the #NaradaScam case.

A bench of Acting Chief Justice Rajesh Bindal and Justice Arijeet Banerjee is hearing an application by CBI to transfer the bail applications from the Special CBI Court to the High Court, citing the "unprecedented mob pressure" exerted by the protests of Chief Minister Mamanata Banerjee and Law Minister Moloy Ghatak.

The bench is also hearing the applications filed by the arrested TMC leaders seeking recall of the stay order passed by the High Court on May 17.

Singhvi : The letter sent by the SG has no mention of Section 407 CrPC. Section 407 mandates the filing of an affidavit which was not present in the case.

Singhvi : Supreme Court has directed to release even hardened criminals taking note of COVID.

Singhvi : Your lordships were given an impression that entire Calcutta was in flames, whereas they were arguing virtually before the Special Court.

Singhvi : He tells your lordship reply, rejoinder, to keep them in jail by hook or crook, more by hook than crook.

    • 19 May 2021 8:50 AM GMT

Singhvi : Principles of natural justice were violated. Aged persons are arrested in a 2014 sting. The stay order was obtained by complete false representation and suppression of facts.

Singhvi : No court can stay interim-bail without giving notice to the accused.

    • 19 May 2021 8:49 AM GMT

Singhvi : Every argument my learned friend(SG) is making to keep them in jail for one more day or two more days. The delicious irony made by the so-called premier agency is that they argued the case here without serving any notice on us.

Ag CJ Rajesh Bindal asks DR AM Singhvi, appearing for TMC leaders, his response to SG's request for time to respond to recall applications.

Singhvi : I agree with my learned friend (SG) that this is an extraordinary case.

Solicitor General : I don't think anywhere else in the country such shocking incidents have happened where a premier investigating agency, which has been entrusted with the investigation by this court, is stopped from doing its job.

    • 19 May 2021 8:45 AM GMT

Solicitor General : There was an orchestrated attempt to frustrate the course of justice. There were unprecedented extraordinary circumstances.

    • 19 May 2021 8:45 AM GMT

Solicitor General : Allow me to file response to the recall applications. The question which the country is asking is whether the highest court of this state would require a premier investigating agency to respond to their allegations.

    • 19 May 2021 8:43 AM GMT

Solicitor General : They (4 TMC leaders) they are not in jail. They are in hospital. They should be in jail, that is my case.
