Luthra says the 407 application was not maintainable and stay could not have been passed.

Solicitor General : Enough of interruptions. I rarely lose my cool.

Luthra : That's right. He rarely loses his cool.

Solicitor General repeats request to file reply to recall applications.

Solicitor General : I have told your lordship about the unprecedented hooliganism which was witnessed.

Luthra : There is a chargesheet filed. There is a remand application filed on the same day. It has no mention of law and order situation.

Luthra : With respect to many other accused, there are revisions pending in the High Court in which stay orders have been passed.

Acting CJ Rajesh Bindal says that the bench was told that CBI won't be able to produce the accused before court because people is sitting outside CBI office.

Luthra : CBI is an agency which is operating under a stay order of the Supreme Court. It is hanging on a stay order. If that stay order goes...we will see.

Luthra says that by the time CBI sent the letter to Chief Justice and Governor, they had approached the Special Court for virtual hearing.

Luthra : The learned Special Judge was hearing the case through VC. The Special Judge was not confronted by anybody.

Luthra says that the accused were not given the copy of the email sent by CBI to the Acting Chief Justice.

Luthra : There is also the issue of maintainability of application under Section 407 CrPC.

Senior Advocate Sidhharth Luthra : It is a question of liberty. We had mentioned the recall application yesterday, so that they are not taken by surprise.
