Baba Ramdev, Acharya Balakrishna Move Kerala Court To Recall Arrest Warrant In Objectionable Ads Case

Baba Ramdev and Acharya Balakrishna have moved an application before the Judicial First Class Magistrate-II Palakkad on February 03 to recall the arrest warrant issued against them in the objectionable ads case. The application has been moved under Section 205 of the CrPC.Today, the application was taken up before the Court, which posted it for hearing on February 11. Earlier, the Court had issued bailable warrants and since there was no appearance, non-bailable warrants were issued to secure their presence. Divya Pharmacy is an affiliated company of Patanjali Ayurved. The complaint is filed by the Drug Inspector under Section 3, 3 (b) and 3 (d) of The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954. Section 3 prohibits the advertisement of certain drugs for the treatment of certain diseases and disorders. Section 3 (b) prohibits advertisements of drugs claiming maintenance or improvement of the capacity of human beings for sexual pleasure. Section 3 (d) prohibits advertisements of drugs that claim the diagnosis, cure, mitigation, treatment or prevention of any disease, disorder or condition of diseases provided in the Rules made under the Act.Divya Pharmacy is the first accused, Acharya Balkrishna the second accused and Baba Ramdev the third accused in the case. Patanjali Ayurved products were under the scrutiny of the Supreme Court for publishing misleading advertisements against modern systems of medicines like Allopathy. The Court later issued a contempt notice to Patanjali Ayurved for continuing to publish misleading advertisements that disparage allopathy and make false claims about curing certain diseases. The contempt cases were later closed by the Supreme Court accepting the public apology issued by Ramdev, Acharya Balkrishna and Patanjali Ayurved. Case : Drugs Inspector Palakkad v.
