The Supreme Court on Wednesday dismissed a writ petition filed by an Advocate who was also a MP Higher Judiciary Aspirant seeking relaxation of upper age limit to appear in the MP Higher Judicial Service Exam.

The bench of Justices DY Chandrachud, Surya Kant and Bela M Trivedi. noting that the petitioner's age was beyond the age limit of 45,  dismissed the plea.

When the matter was called for hearing, Justice DY Chandrachud the presiding judge of the bench said, "Even Art 142 will not permit us to do something contrary to law."

Referring to the recent decision which relaxed upper age limit of 45 years for the Delhi Higher Judicial Service Examinations (DHJSE) of 2022 for those candidates, who were eligible in 2020 and 2021 but have become age-barred this year, Justice Surya Kant said,

"After the relaxation which this court has granted, are you now eligible for Delhi?"

Justice DY Chandrachud further asked, "Would you have qualified in 2020-21?"

On petitioner answering in negative, Justice Kant further asked if there was any age relaxation for Schedule Caste candidates.

"No age relaxation in Delhi and MP," petitioner responded.

"We have full sympathy with you. All the best for your career as a lawyer, you will succeed in the bar," the bench remarked while refusing to grant the reliefs sought.
