“Patna police has no jurisdiction to register a case” says Divan — counsel for Rhea Chakraborty.

Divan reads #Rhea’s affidavit:

Petitioner was in love with the deceased #SushantSingh.

She is now being trolled and victimised.

Divan further reads out the allegation levelled against #RheaChakraborthy by #SushantSinghRajput’s family which pertain to fraud & there being no #mentalhealth issues with Sushant.

Divan reads out allegations and averments laid down by sushant’s father.

He says that sushant’s father has alleged many things against the Bollywood actess including disallowing him from talking to his Family & pressurising him to return to Mumbai the time he visited Patna.

Divan: i would like to point out, Rajeev Nagar is the address of #sushant’s father — where FIR was filed. This has no consequence.

Divan: Now returning to my Transfer petition, I would like to state points that are subject of FIR:

“Wrongful confinement, abetment, theft, criminal breach of trust is whats laid down in the Patna FIR against #RheaChakraborthy”

Divan says that Bandra PS has jurisdiction to handle the case 

Divan now refers to #RheaChakraborty’s additional affidavit that the Bollywood actress filed before Top Court yesterday

Divan: Considerable delay — nearly 38 days for filing of FIR in Patna.

We also want to submit that there is an apprehension of justice.

Justice shall only be met if my client’s prayers are allowed. 

Divan tells the bench about all pleadings that have come in record.

#RheaChakraborthy also filed an affidavit, says Divan.

He now says that in so far as the July 25th july is concerned (Patna), it has nothing to show that an offence was committed there.

Divan for Rhea says that he is requesting to place on record some facts.

“August 5 order already passed and time was granted for response. Those responses have come in and we have impleaded state of Maharashtra as well.”
