The Supreme Court on Thursday directed GVK Power (Goindwal Sahib) to approach the Punjab and Haryana High Court to challenge the decision of the Punjab State Power Corporation Ltd to terminate the power purchase agreement with it.

The Court however restrained the Punjab authorities from taking any coercive action against GVK power for a period of two weeks. With these directions, the bench comprising Chief Justice of India NV Ramana, Justice AS Bopanna and Justice Hima Kohli disposed of the writ petition filed by GVK Power under Article 32 of the Constitution challenging the termination of the agreement. Senior Advocate Maninder Singh, appearing for the petitioner, argued that authorities were taking high-handed actions against it despite knowing that the matter was listed before the Supreme Court.

"Is it fair to take coercive steps when the Court is going to consider the matter? Why such high handedness?", CJI asked Senior Advocate P Chidambaram who was appearing for the State of Punjab. Chidambaram submitted that the petitioner should be asked to avail the alternate remedy before the High Court.
