MP Opposition Leader Withdraws Plea In Supreme Court Against Issues Framed By HC In Challenge Against Jyotiraditya Scindia’s Rajya Sabha Election

Senior Advocate Anoop George Chaudhary told a bench of Justices Hrishikesh Roy and Pankaj Mithal on Monday that Singh has decided to withdraw the latest petition in the Supreme Court.

The now-withdrawn appeal was filed against the Madhya Pradesh High Court refusing to review an order framing issues in Singh’s election petition. The Congress legislative assembly member has challenged Scindia’s candidature as a returned candidate from the Bharatiya Janata Party in the June 2020 Rajya Sabha election on the ground that he had not disclosed particulars relating to a first information report (FIR) registered against him. In view of the mandate of the Representation of the People Act, 1951 requiring all contesting candidates to furnish all requisite details as required in the nomination form along with the affidavit, Singh has accused the BJP legislator of suppressing material facts.

In the election petition, the Madhya Pradesh High Court has framed only a preliminary issue of whether mere registration of an FIR amounted to the pendency of a criminal case which attracts the disclosure provision under the RP Act, Singh argued before an apex court bench headed by Justice Roy. On July 7, the top court, however, declined to interfere with the issue framed by the high court.

Scindia was represented before the Supreme Court by senior advocates NK Mody and Siddharth Bhatnagar along with Advocate Fareha Ahmed Khan and a team from Karanjawala & Co. Advocates comprising Tahira Karanjawala, Arjun Sharma, and Shreyas Maheshwari.
