The Supreme Court on Friday issued limited notice on the petition filed by Member of Parliament Asaduddin Owaisi challenging the order of Allahabad High Court granting bail to two persons accused of firing at his vehicle on February 3 this year.
The limited notice is issued to consider whether the High Court should be asked to reconsider the matter. The Hyderabad MP has taken an argument that the High Court passed the order without hearing him as the victim of the crime. Reference has been made to the recent order passed by the Supreme Court which set aside the bail granted to Asish Mishra in the Lakhimpur Kheri case on the ground that the victims were not heard.
However, the bench comprising Justices MR Shah and Krishna Murari dismissed another petition filed by the AIMIM leader challenging the bail granted to one accused Aleem who allegedly handed over the pistol six months ago to the attackers.
When the matter was taken, the bench asked Owaisi's lawyer Advocate MR Shamshad how the accused Aleem could be connected to the crime when the allegation was that he had handed over the pistol to the assailants 6 months ago.
Regarding the other accused, the bench asked whether any Test Identification Parade was carried out. When the counsel answered in the negative, the bench asked how they could be connected to the crime. The lawyer stated that the accused persons are themselves claiming to have attacked Owaisi. He referred to certain statements made by accused Sachin Pandit, after being released on bail, whereby he made prideful claims of having attacking Owaisi. The accused is showing no remorse and has made threatening comments, Shamshad submitted.
"He is saying our two former Prime Ministers were so powerful, see their fate...", the counsel said.
