Supreme Court will continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

Yesterday, Senior Advocate Kapil Sibal has drawn the court's attention towards the issue of collaboration of the key functionaries of the State with the accused persons, referring to the documents submitted by him along with the Protest Petition. It was his submission that the SIT did not make investigations regarding the collaboration and the allied issues, when there was evidence before it.

During the course of four days until today, Mr. Sibal contended that the Special Investigation Team had neither looked into the reports by the National Human Rights Commission, Election Commission, or the Committee on Empowerment of Women set up by Parliament with respect to the Gujarat riots nor did they examine the members of such commissions. He also demonstrated the flaw in SIT's stand that there was no violence or arson.

SIT has not challenged the Gujarat High Court's decision to acquit Maya Kodnani, former BJP MLA from Naroda, who was identified as the 'kingpin' in the Naroda Patiya massacre of 2002 by the trial court, Mr. Kapil Sibal argued hinting at the political optics of the SIT not challenging the High Court order. Senior Advocate Kapil Sibal told the Supreme Court that the SIT head RK Raghavan was appointed as a High Commissioner later, and all these people who 'collaborated were rehabilitated later.

Sibal: There were SIB messages before train arrived.

Bench: Why are you emphasising on post-mortem?

    • 17 Nov 2021 2:55 PM IST

Bench: How does it establish larger conspiracy? What's the relevance. DM said how it was done. It was not done as some larger conspiracy. Give us that material first, we had said. You are more concerned about larger conspiracy.

    • 17 Nov 2021 2:51 PM IST

Sibal: All of this was pointed out by me in the protest petition. This record was available with SIT. They should have acted on it.

    • 17 Nov 2021 2:51 PM IST

Sibal: Post mortem over by 6:45 by the time inquest report was signed. Under whose orders were the post mortem being carried out at the railway yard itself... Mobile phone records show Ashok Bhat giving instructions. None of this investigated. No questions asked by SIT.

    • 17 Nov 2021 2:48 PM IST

Sibal: Phone calls of the brother of Togadia on 27.02.2002. [Among others called Maya Kodnani, inter alia, for distribution of weapons.]

    • 17 Nov 2021 2:48 PM IST

Sibal: If I receive a call then the call record shows that I am on call, I am also there. It is only data. Whether it required investigation or not is for the investigating officer.

    • 17 Nov 2021 2:48 PM IST

Sibal: When I receive a call, the tower will tell me where I am. Location is recorded with respect to call or message.

    • 17 Nov 2021 2:47 PM IST

Bench: PC Pandey's statement recorded. What did he say? He could have left his phone in office. This chart is showing location not call record. Chart only supports your contention. Does not establish it.

    • 17 Nov 2021 2:46 PM IST

Bench: He has not moved out of office, that is what you are saying. It is not 3 o'clock, it is below. We have noted that he had not moved from his office.

Sibal: An investigation should have been carried out.

    • 17 Nov 2021 2:39 PM IST

Sibal: He (PC Pandey) was throughout in office.

[There is some confusion about timing] The Bench asked about the timing in the chart w.r.t. PC Pandey being in office.
