    The Supreme Court will hear today the Masjid Committee's plea challenging the survey ordered by a Varanasi Court in Gyanvapi mosque complex.

    A Varanasi Court directed the sealing of a spot in the Gyanvapi Mosque complex after being told that a Shiva Linga was found inside premises by the court-appointed Advocate Commissioner during the survey. 

    Anjuman Intezamia Masajid Management Committee has moved Supreme Court challenging the survey ordered by a Varanasi court in Gyanvapi Mosque premises on a plea by a few Hindu devotees.

      J Chandrachud : The only point, we are only discussing, the basis of your challenge that the grant of relief is precluded by #PlacesOfWorshipAct, that is the relief you sought in application under Or 7 Rule 11. We'll direct the trial court to dispose of that application.

      Ahmadi : Also, an earlier suit was stayed. All these orders are illegal and should stand still and the status quo as on the date of the suit must be maintained.

      J Chandrachud : What we can do, we can issue a direction to the trial judge to first dispose of your application under Order 7 Rule 11 (for rejection of plaint).

      Ahmadi : Also a stay of all these orders. These orders are against a law of Parliament.

      Ahmadi : This Court categorically held that the religious character of a place as on August 15, 1947 cannot be tinkered. These kind of orders hold grave potential for mischief.

      Ahmadi : I have filed an IA challenging it. This is clearly in the teeth of your lordship's order in the Ayodhya case.

      Ahmadi : What is happening is, under the garb of commission proceedings, and on the oral plea of the plaintiff according to what he saw, the entry to the mosque is restricted and the spot is sealed.

      Justice Narasimha : The application was filed by the plaintiff during the pendency of the commission?

      Ahmadi : Yes.

      Ahmadi : Despite the fact that no report was filed by the Commissioner, an application was filed by the plaintiff that commissioner noticed a shivling near pond. This is highly improper as the Commission report is supposed to be confidential until it is filed.

      Ahmadi : What the HC said it is innocous and nothing will happen is belied by subsequent events. On Saturday and Sunday Commissioner went to execute the task. Commissioner was fully aware that this court is in seisen of the matter and is likely to be listed today.
