    Supreme Court will continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

    During the course of 3 days before today, Mr. Sibal took the bench through the documents to demonstrate the failure of the SIT in investigating the matter and the flaw in SIT's stand that there was no violence or arson. SIT has not challenged the Gujarat High Court's decision to acquit Maya Kodnani, former BJP MLA from Naroda, who was identified as the 'kingpin' in the Naroda Patiya massacre of 2002 by the trial court, Mr. Kapil Sibal argued hinting at the political optics of the SIT not challenging the High Court order. Senior Advocate Kapil Sibal told the Supreme Court that the SIT head RK Raghavan was appointed as a High Commissioner later, and all these people who 'collaborated were rehabilitated later.

    Senior Advocate Kapil Sibal is arguing for the petitioner, Zakia Jafri, widow of Congress MLA Ehsan Jafri who was killed in the Gulberg Housing Society massacre during the 2002 Gujarat Riots. She approached the Supreme Court through a special leave petition challenging the SIT report which ruled out any "larger conspiracy" by high state functionaries in instigating the communal riots following the Godhra massacre.

      Sibal: Before we go there, there is judgment of Mad HC dated 5th of Feb, 2021, then in appeal before SC.Judgment relating to NHRC and recommendation. The statutory effect of the recommendations. Only to that point.

      Sibal: Reads on...58 cases of sexual harassment were to be properly investigated so as to do justice. Kindly See para 44, Committee noted no efforts made to identify hate literature circulated in the State. All these material were part of protest petition but nothing was done.

      Sibal: Another report your lordships will find in Vol. XI. Milords, is the Committee on empowerment of women, 9th Report. This would be part of Parliamentary records. This would be available to both Govt and SIT. Again no one examined.

      Sibal: In Kheda district the team was told that culprits were identified, but not arrested. [Same situation in 10 districts visited by the EC team] SIT did not go to the EC which is a constitutional authority. Then what was the SIT doing.

      Sibal: A constitutional authority calls them abettors. I am not saying anything. IPS officers who did incredible work were replaced... Then, they decided to postpone the election.

      Sibal: EC had to go to Guj. That constitutional authority reaching Guj also made some observations. Your Lordships will see that date is 16th of Aug, 2002. [Reads the number of police stations affected and the electoral roll to give indication of the magnitude of the incident]

      Sibal: So, an action under Section 12A. That is now the Commission acted. So this was a statutory exercise. They are also entitled to give recommendations under S.12A. Now Milords. Your lordships will notice that from March 1 right through, in the middle there was a issue of EC.
