    In the case where the Supreme Court directed CBI probe into the filing of a fake petition before it, the agency recently informed that an FIR has been registered against 10 known persons (and those unknown). Out of the 10, 3 are advocates practising before the Supreme Court and 5 are practising before the Allahabad High Court.

    The matter was before a bench of Justices Bela M Trivedi and Satish Chandra Sharma, which delivered judgment in the matter on September 20, passing directions for the CBI probe.

    To recap briefly, the order impugned in the SLP had put an end to criminal proceedings against the only witness in the 2002 Nitish Katara Murder case. However, as informed by respondents during court proceedings, the SLP was filed in an attempt to continue the false case against him (without the petitioner's knowledge).

    Not taking the case lightly, the bench came down heavily on certain respondents, their associates and advocates, who appeared to have forged and fabricated documents to be filed in Courts, to pursue false proceedings in the name of petitioner. Underlining advocates' responsibility towards the court, the bench observed that no professional was immune from prosecution for criminal deeds.

    Recently, a miscellaneous application was filed in the matter and the CBI placed on record an enquiry report. As per the said report, the agency, after conducting a Preliminary Enquiry, registered a regular case against 10 accused (and other unknown persons) to unearth the "deep rooted conspiracy" behind filing of proceedings before the Supreme Court and the High Court.

    The offences alleged include Section 120B read with Sections 205, 209, 420, 465, 466, 468, 471 and 474 of the IPC.

    Disposing of the miscellaneous application, the Court said that the accused as well as the CBI would be at liberty to take further recourse of law, as permissible. The Court's order also recorded the names of the accused persons.
