Supreme Court today (June 28) extended the interim bail of BSP Leader and Former MLA Uday Bhan Singh who was convicted in a 1999 murder case. The Court also issued notice to his contempt petition alleging inaction by the State Authorities against the order directing his premature release.
The vacation bench of Justices AS Oka and Ahsanuddin Amanullah was hearing a contempt petition filed by Singh against Mr Deepak Kumar, Principal Secretary, Department of Home Secretariat, Uttar Pradesh in violation of an earlier order of the Court dated April 29.
As per the Order of April 29, the writ petition for premature release of the MLA was allowed by the Top Court. The Court granted the benefit of parity to the MLA as 3 of the co-accused had already been granted pre-mature release. The State Authorities were directed to dispose of his application for release within a period of 6 weeks from the date of the order. Singh was granted interim protection till July 9 before surrendering.
The bench while issuing notice directed the Principal Secretary to comply immediately and pass orders according to the directions of the April 29 Order. Singh was also granted an extension of time to surrender till July 26.
"Issue notice to respondent returnable on 26th July. We expect the respondent to make compliance immediately with the order dated 29th April 2024 and place the order passed on record. In the meanwhile, we extend the interim bail granted to the petitioner under the order dated April 29, 2024 till the returnable date."
The matter pertains to MLA Singh's conviction in a 1999 criminal case for murdering three persons along with 10 other co-accused by the Trial Court. Singh was sentenced to life imprisonment and has currently undergone actual custody of 20 years and 7 months.
The matter will now be heard on July 26.
The petition was filed with the assistance of AOR Divyesh Pratap Singh.
