    Supreme Court has commenced the hearing on petitions seeking cancellation of compartment examination 

    During the hearing yesterday, Advocate Abhishek Choudhary, appearing for the intervenors(private and second compartment students of CBSE), told the Bench that it has been stated by CBSE that the exam will be held when the situation is "conducive".

    "Clause 29 of the Evaluation Policy talks about private and second compartment students, and states that examination will be conducted when time is conducive to conduct examinations. If this is the scenario then unequal treatment will be given to regular students and private students." Choudhary submitted.

    "If they appear along with other students when exams are conducted then what will be the difficulty? Second compartment students can appear in the proposed exams to be conducted by concerned Boards for improvisation of Students." the Bench asked.

    Choudhary responded saying that the difficulty would be that, if a compartment student does well in say an entrance test like CLAT, he can't take admission because Class 12 exam for compartment students are in abeyance. Further, he added that CBSE's clause says that environment needs to be conducive, but when the environment will be conducive cannot be said.

      Bench to AG: Does this mean, compartment students will not get admission this year and will have to wait for one year.

      AG: From 15th August they are planning to conduct the exams. Please add subject to conducive condition

      Bench to AG: What we’re suggesting is after declaring results on 31st a July, you may ask them to confirm if they will take exams. That can then be conducted with these compartment candidates if number is not alot.

      Bench: Exams will start on 15th exams and considering there’s are many subjects it will be done by 15 September

      Bench to Choudhary: Didn’t you hear the AG, UGC will direct colleges to hold on the admissions.

      Bench: Now don’t suggest that they will come to your House and take exams. How can how the exams have to be conducted be decided here.

      Choudhary: If date is provided, there are institutions in India that take direct admissions based on class 12th marks. These seats will then be filed by the regular students

      AG: I’m told Compartment students were given opportunity last year then they failed, and now they are asking for an exam again.

      Bench: We don’t know if they are same set of students. Its not correct to say that they are same students. That’s not a correct students
