Supreme Court Allows Temporary Allocation Of Fixed Spot For Meat Vendors In Panjim

The Supreme Court recently allowed displaced meat vendors to be allotted fixed spots in a temporary fish market in Panjim, Goa after City Corporation's demolition of the building where the vendors were lessees for over 30 years.
The bench of Justice BV Nagarathna and Justice SC Sharma was hearing the challenge to the order of the Bombay High Court which directed the Corporation of the City of Panaji(CCP) to construct and maintain public markets and slaughterhouses, and to regulate all markets and slaughterhouses in the interim period, in the public interest.
The said direction was issued in light of the demolition of the building where the respondents were carrying out trade operations. The demolition was carried out due to the dangerous and dilapidated condition of the building. Here the shops of meat vendors were affected.
The CCP challenged the order contending that the direction is beyond the statutory ambit of the CCP under S. 59 of The City of Panaji Corporation Act, 2002. Notably. S. 59(1)(o) states the CCP to take adequate measures for "the construction and maintenance of public markets and slaughter-houses and the regulation of all markets and slaughter-houses;"
During the hearing, the CCP submitted that as per its latest resolution of January 24, it has agreed to provide a fixed spot in the southeastern part of the temporary fish market to 6 meat vendors.
The counsel for the vendors argued that the vendors be additionally permitted to install fridges, mincers, and mincing machines with electricity,and water and that the area allotted be enclosed and secured.
The Court permitted the same and clarified that such an allotment would be purely on a temporary basis. While the Court refused to interfere in the issues raised by non-meat vendors, it directed that the other vendors seeking to enforce their lease rights may file a civil suit.
The meat vendors were represented by Sr Adv. Atmaram NS Nadkarni, and advocates Rohit Braz D'sa, S.S Rebello. The CCP was represented by Sr Adv Ranjit Kumar.
