Supreme Court Allows Candidate With Locomotor Disability To Appear For Rajasthan Civil Judge Interview

The Supreme Court today (October 25) allowed a candidate with locomotor disability to appear for the interviews for Rajasthan Civil Judge.
The bench of Justices JB Pardiwala and Manoj Misra was hearing the plea of a petitioner who suffers from locomotor disability to the extent of 60% cleared the preliminary and main examinations with 111.5 marks.
Sr Advocate Shadan Farasat appearing for the petition submitted the petitioner was not called for the interview because he couldn't clear the cut-off under the OBC Category under which he would fall apart from the Disability Category.
Considering the recent order passed yesterday by the bench of CJI DY Chandrachud and Justices JB Pardiwala and Manoj Misra which allowed a blind candid to appear for the interviews in the same exam, the Court directed the following:
“In such circumstances above, since the interviews will conclude on Saturday, we direct that the petitioner Ishaan shall be called for the interview.”
After the dictation of the said order, Advocate Mukul Kumar appearing for the Rajasthan High Court requested the Court to clarify that the present direction not be used as grounds of equity in other cases.
To which Justice Pardiwala replied asking the counsel to be more considerate in such matters.
“You should have that empathy, you should have that heart!”
In yesterday's matter, the petitioner suffered from blindness and had qualified for the preliminary examinations to appear for the main exams. In the mains, the petitioner scored 113.5 marks but was not called for the interview because he failed to fulfill the cut-off of the Economically Weaker Section (EWS) category to which he belonged.
While issuing notice in the present matter, Court also asked counter affidavit to be filed before the next hearing on November 4.
