In a relief to noted playback singer Anuradha Paudwal, the Supreme Court on Thursday stayed the proceedings in a case filed by a 46-year-old woman claiming that she should be declared as her biological daughter
A bench headed by CJI SA Bobde issued notice to Kerala-born Karmala Modex, who filed the case against Paudwal in Family Court, Thiruvananthapuram.
The top court was considering the petition filed by Anuradha Paudwal and her two children seeking transfer of case from Thiruvananthapuram to Mumbai.
Filed through her advocate Swarupama Chaturvedi , Paudwal's petition sought transfer of case to Mumbai citing her old age and professional commitments.
Appearing for Paudwal, Sr Advocate P S Narasimha sought stay of the proceedings pending before the Thiruvananthapuram court.
Paudwal, a 2017 Padma Shri award recipient, alleged that Modex's suit was an attempt to extort money and blackmail her to disrepute.
She said that that the suit was based on a bogus claim, as she had got married five years ago the year in which Karmala Modex was stated to have been born.
Modex also sought a compensation of Rs 50 crore from Paudwal for allegedly denying her the childhood and the life which she was entitled to.
Modex said that she came to know about the fact five years ago from her foster father Pannachan, who had told her about it at his death bed.
Ponnachan and Agnes, her foster parents, had brought her up, she said.
The Thiruvananthapuram Court earlier this month had asked Paudwal and her two children to appear in person before it.
Modex said she had tried to get in touch with the singer before filing the case but never got any response.
