RG Kar Incident Not Gang Rape, Investigating Alleged Cover-Up: CBI Tells Calcutta HC, State Questions Revival Of Concluded Investigation

The CBI on Friday told the Calcutta High Court that it had concluded from its investigation and available expert medical opinion that the rape and murder incident of a trainee doctor at Kolkata's RG Kar medical college and hospital was not an instance of gang rape.
DSG appearing for the CBI told Justice Tirthankar Ghosh that the agency was presently investigating the involvement of people in the events that occurred after commission of the substantial offence in order to cover up the incident that took place.
These submissions were made in a plea by the victim's parents seeking further investigation into the case. Earlier, the Supreme Court had asked the parents to approach the Calcutta High Court to redress their grievances.
Senior Counsel appearing for the state submitted that while the state did not object to the investigation into the alleged cover-up of the incident, the question on law would be whether the court could revive a concluded investigation, which had been ended with the conclusion of the trial which saw Sanjoy Roy be sentenced to life imprisonment for his involvement in the offence.
"Can a trial be revived? If it cannot he revived, how can you order further investigation after the conclusion of the trial?" counsel questioned.
Accordingly, the court directed the CBI to produce a list of witnesses examined by it as well as the case diary received from the Kolkata police when the CBI took over the investigation.
On asking for a timeline, DSG informed the court that a timeline could not be committed to and that the agency was investigating various aspects.
Court thus directed the CBI to submit the reports as asked to determine what roadblocks were being faced by the CBI in investigating the matter.
