A writ petition has been filed before the Supreme Court challenging the application of reservation for Economically Weaker Sections(EWS) and Other Backward Classes (OBC) in the All India Quota seats for NEET-MDS 2021.
The petition seeks directions to conduct the counselling for Masters of Dental Surgery (MDS) seats under the NEET-AIQ without the EWS/OBC reservations. The petitioners seek directions to the Medical Counselling Committee to proceed with NEET MDS Counselling on the basis of earlier reservation policy & not as per notice dated July 29, 2021, which introduced EWS/OBC quota.
The Supreme Court will consider the petition for admission tomorrow.
It may be noted that the Supreme Court is presently hearing a batch of petitions challenging the decision taken by the Union Government on July 29 to introduce reservation for EWS/OBC categories in the medical UG and PG seats under the All India Quota. Today, a bench led by Justice DY Chandrachud had questioned the basis of the Rs 8 lakh annual income criteria adopted by the Central Government for EWS quota.
Incidentally, to oppose the petitions filed by PG doctors, the Additional Solicitor General KM Nataraj, appearing for the Union Government, had submitted that EWS/OBC quota has already been implemented for NEET-MDS AIQ.
Earlier, a group of BDS students had approached the Supreme Court aggrieved with the long delay in announcing the counselling dates. Endorsing the grievances of the students, a division bench comprising Justices DY Chandrachud and MR Shah had observed that the delay in holding the counselling was affecting the future of the students. The Bench had observed that the delay in counselling would lead to serious consequences to the students, who have been waiting after the test results were announced on December 31, 2020.
Following the strict directions from the Court, the counselling dates were formally announced on August 10.
