The Supreme Court will hear today petitions seeking 100% verification of EVM votes with VVPAT slips.

A bench comprising Justices Sanjiv Khanna and Dipankar Datta will hear the petitions filed by the Association for Democratic Reforms and others.

Responding to the petition filed by ADR, the Election Commission of India had cited practical difficulties in verifying all VVPATs. Earlier, a bench led by Justice Sanjiv Khanna, while hearing ADR's petition, had expressed reservations about the demand for 100% VVPAT verification, saying that it would add to the ECI's burden without much significant advantage.

Court: problem with data is that it must be authentic, not based on opinion but actual performance.

We will get the data from the EC.

    • 16 April 2024 10:33 AM GMT

Court: Mr Bhushan you said majority of voters don’t trust EVM? How did you get that data?

      Bhushan: there was a poll

Court: let’s not believe in private polls. Let’s not go into all that. To examine we have to see the data

    • 16 April 2024 10:33 AM GMT

Bhushan: if there is a mismatch between VVPAT and EVM, they only let VVPAT count prevail in that polling station.

They do not check the others. They are only sampling 5 VVPAT machines.

Earlier they said that the discrepancy was because mock poll data was not cleared as if there is no possibility of manipulation.

Why not check the other VVPATs?

Court: even if 10% people raise objections the whole process will stop

Sankarayanarayan: yes it must, I am entitled to ask! I am a voter, what do I gain by deliberately stopping the process

    • 16 April 2024 10:29 AM GMT

Court: at this stage, paper slip is not given. Voter can ask. But then the whole process has to stop and the machine has to be opened?

Is this rational? You can ask in case there is a discrepancy

Sankarayanarayan: there is a declaration that the voter has to sign. What have I gained? I am only pointing out a discrepancy

    • 16 April 2024 10:22 AM GMT

Sankarayanarayan: in LS candidates have 44% criminal records. Leave them. The voters need physical interface and verification. Allow me to pick up the slip and put it in the box.

5000 cr has been spent, they want one nation one vote, do this little bit.

    • 16 April 2024 10:20 AM GMT

Court: candidate can ask for the counting or paper slips, and the election officer can pass an order. In case of a discrepancy, candidate can exercise their right

Sankaranarayanan: I am least concerned about the candidate. I am concerned about the voters fundamental right to know what happened to their vote.

    • 16 April 2024 10:17 AM GMT

Sankaranarayanan: these discrepancies from 2019 were accepted by a Parliamentary committee which said that the EC did not respond to them.

If this has happened, can we doubt the system? Otherwise you can say there is a huge population.

I am not saying anyone did anything. I am saying there is high chance of error.

    • 16 April 2024 10:16 AM GMT

Court: machines are manipulated by humans. When you do hand counting, there will be different numbers counting.

Sankaranarayanan: in the 5% VVPAT that they are counting, there are no discrepancies

    • 16 April 2024 10:14 AM GMT

Court: you will see why the candidate didn’t challenge in pg 439.

The mismatch was much less than than the MoV.

This is a humongous task, no European country can do this.

My home state WB has more population than Germany. We must repose some confidence.
