    The Supreme Court will continue hearing today the cases related to OBC/EWS reservation in NEET-AIQ. The cases are listed as item number 33 before a 2-judge bench comprising Justice DY Chandrachud and Justice AS Bopanna.

    The hearing is likely to determine whether the counselling for NEET-PG admissions will commence soon or not.  Yesterday, the Centre had requested the Court to allow the commencement of the counselling. The bench then sought the response of the petitioners opposing OBC/EWS reservation. Senior Advocates Shyam Divan and Arvind P Datar made arguments yesterday (for reports of their arguments, read here and here).

      Datar :  Lordships may direct 2.5 L should be limit for this year for today's counselling. Rest we can see later. Let us at least preserve the integrity of Sino Commission.

      Datar : If at all they want to go ahead with EWS, let it based on the criteria of Sinho committee. Let your lordship issue directions under Art 142 to consider the same to 2.5 lakh if your lordship wants to uphold the same.

      In Pandey Report they have not mentioned about any study.

      Datar: Please see what they have said for eliminating asset criteria. The counselling will start now. How will the children get all the compliances?

      Datar points out the difference b/w OBC and EWS as mentioned in Pandey Committee report.

      I don't know why there's difference. If you're adopting for both, adopt the same.

      Datar: I'll now refer to Shanti Star Builder's case that has been mentioned in the Pandey Committee report.

      If you go by asset plus income criteria- my friend points out that in 7th pay Commission, salary of class 4 employees in the govt is 18k to 30k and now if you take this into consideration, none of the children will be able to qualify.

      Children who go for tuition classes of NEET have to pay high fees.

      The test is proper and appropriate identification. That was also one of the criteria in Mandal.

      Datar: All the asset criteria has to go because 1000 sq of residential flats in Bombay etc, your lordship knows.

      There is complete non application of mind.

      Datar : As far as income criteria is concerned, it is over-inclusive, it is a top-down approach and it denies benefit to real people under EWS.

      Datar : Now the asset category of 5 acres. For example, in Kerala, holding 5 acres is difficult due to high population density. Keeping national limit of 5 acre is completely wrong.
