    The Calcutta High Court is hearing the Narada case related to the bail of four Trinamool Congress leaders - Firhad Hakim, Madan Mitra, Subrata Mukherjee and Sovan Chatterjee- who have been under judicial custody since their arrest by the CBI on May 17.

    A 5-judge bench comprising Acting Chief Justice Rajesh Bindal, Justices IP Mukerji, Harish Tandon, Soumen Sen and Arijit Banerjee is hearing the case. The arrested leaders - two of them ministers and one of them an MLA- were placed under house arrest by a division bench on May 19.

    Solicitor General Tushar Mehta (for CBI), Senior Advocates Dr AM Singhvi, Sidharth Luthra and Kalyan Bandopadhyaya (for TMC leaders) and Advocate General Kishore Dutta are appearing in the the matter.

      Singhvi : On May 17, you get the bail stayed on an oral application and two days later you file a big fat affidavit saying Calcutta was under martial law!!

      Singhvi : The opening arguments of Mr.Mehta suggests that he wants to go into all questions except the question of bail. The issue of bail is being blocked.

      Singhvi says that public intimidation is not a ground to cancel bail. These people are entitled to bail as per settled tests of bail. All "delicious questions of law" raised by Mr.Mehta can wait.

      Bandopadhyaya : In my 40 years of practice, I have never seen such a thing in Calcutta High Court.

      Bandopadhyay : Hearing will go on for 4-5 days and my clients will remain in custody! 


      In a matter of liberty, the recall applications cannot be kept aside. I have answers to all Solicitor's submissions. But let the recall applications be heard first.
