Kerala Actor Assault Case: Supreme Court Issues Notice On Main Accused Pulsar Suni's Plea Seeking Bail

The Supreme Court on Wednesday issued notice in plea by Sunil NS alias Pulsar Suni, co accused of Malayalam actor Dileep in the 2017 sexual assault case seeking bail.
A bench comprising Justice Ajay Rastogi and Justice Bela Trivedi issued notice in the special leave petition filed challenging Kerala High Court's order dated 29th March 2022 dismissing Suni's bail application.
The petitioner was represented through Advocate K Parameshwar, Advocate Sriram Parakkat and Advocate Satheesh Mohanan.
The present petitioner Sunil NS with 9 others including actor Dileep are accused of abducting and sexually assaulting an actor in a moving car. Suni is accused to be the main assailant of the crime.
The petitioner has been accused of committing offences under Secs.120B, 201, 212, 342, 366, 376(D) & 506(i) read with section 34 of the Indian Penal Code and under Sections 66E & 67A of the Information Technology (Amendment) Act, 2008.
The petitioner has been in judicial custody for the last 5 years and 2 months ever since 23.02.2017.
The petitioner has argued that he is the only accused in the present case who is behind the bars in an unending pre-trial detention. Further, his bail application has been dismissed solely on the ground of an apprehension that releasing him on bail would amount to giving a wrong signal to the society
The petitioner has submitted that the examination of almost all witnesses is over and the investigating agency has started further investigation and invariably there will be much more witnesses to be examined after further investigation. Therefore there is no likelihood of the case coming to a conclusion in the near future.
The petitioner has also cited Supreme Court's recent order granting bail to his co accused driver Martin Antony who has been behind bars for almost 5 years.
In 2017, a popular actress was allegedly abducted and raped in a moving vehicle pursuant to a conspiracy, allegedly plotted by Dileep.
The case made headlines once again in 2022 when film director Balachandrakumar made shocking disclosures against the actor bringing out new allegations against him.
Kerala High Court in March 2022 dismissed the plea moved by actor Dileep seeking to suspend further investigation into the 2017 sexual assault case.
