Justice Dixit : And Justice Mustaque (who authored the two cited judgments of Kerala HC on hijab issue) is one of the finest judges of the country.

Justice Dixit : Even Upanishads say that knowledge from everywhere must be welcomed.

Bench allows Raj to interevene.

Raj says he was instructed to move a PIL on the issue and that he has been listening to the hearing. He seeks permission to address the court as an intervenor.

Justice Dixit : Most welcome. The Prohpet said the Ink of the scholor is more holier than the bloddo of a martyr.

Justice Dixit : Ah, from the Gods own country!

Kamat says that this judgment is in a different context. It was in a private school run by Christian management and it was in that context that Court held permission to wear head scarf cannot be ordered.

Kamat refers to another judgment of the Kerala High Court, which held that a school cannot be directed to allow Muslim students to wear headscarf. This judgment has been cited in the Karnataka Govt GO, he adds.

Kamath: When appeal was pending CBSE came out with other notification, they said if you are wearing the religious dress then come one hour before to allow frisking and petitioners did not oppose saying it was fair.

Kamat says that the division bench upheld this judgment of the single bench of the Kerala HC.

Kamat refers to another para from the Kerala HC judgment saying that there are possibilities of different views and opinions but that by alone is not a ground to deny the freedom, if the propositions have some foundation in the claim.
