Supreme Court will today hear the petitions Seeking Postponement of CA Examination/ Opt out Options/Extra Chances/More Exam Centres.

Justices AM Khanwilkar, Dinesh Maheshwari and Aniruddha Bose is hearing the case.

Yesterday, ICAI also submitted a Brief Note to the Supreme Court stating that COVID-19 spread is now at a substantially low level, and that it would be in the best interests of the candidates to hold the examination as per the schedule.

The brief note, submitted to the Supreme Court in the plea seeking postponement of the CA exams, as well as opt-out and extra chance options, states that ICAI has a statutory duty under Section 15(2)(b) of the Chartered Accountants Act 1949, to hold the examination and that they are trying to ensure that all mandated COVID-19 protocols will be in place.

For Opt-Out option, the Brief Notes states that announcement dated 21 June 2021 has allowed opt-out option in case the examinee or his/her family members residing in the same premises are infected with COVID-19 on or after 21 June, and that this option can be exercised on production of COVID-19 positive RTPCR report.

Bench: It’s all about giving one opportunity. This is also the old syllabus. Shifting from old syllabus to new syllabus. Preparation is also very hard.

Bench: Some people have not even recovered after 2-3 months. Not just our experience. We have read reports of how there are different symptoms. One person recovered, but despite one shot of vaccination, he ended up on the ventilator after one week.

Bench: Authority should also have some medical experience. Not like us.

Srinivasa: We completely bow down that the experience you had should not be felt by others.

Bench: Inability to appear due to appear due to COVID or disability if he’s recovered and there are long term effects. Himself and for his family members. He can give the justification and the authority can decide whether he should be allowed or not allowed.

Srinivasan: Your suggestion is completely welcome. Institute will keep this in mind and immediately issue a circular identifying an authority that can certify if a candidate is unable to appear.

    • 29 Jun 2021 7:15 AM GMT

Justice Khanwilkar: You are appearing before a Bench out of which two have had personal experience of COVID. There is the fatigue factor. It was horrible. You cannot expect a CA candidate to function fully and study then

Bench: That’s why we have indicated that not just COVID, but also COVID related problems need to be considered. You have to look at it from all angles. There are various permutations and combinations.

    • 29 Jun 2021 7:12 AM GMT

Bench: You only concentrated on COVID POSITIVE RTPCR and nothing more. You have to take inputs from experts. The entire cycle of infection is 14 days max. But after suffering from COVID, people are getting affects for three months. Have you taken that into account ?
