A plea has been preferred in the Supreme Court seeking issuance of directions to the Centre & States for enforcing the Farmers Act and to make rules and guidelines against agitation and processions by political parties and organisations.
The plea filed by Hindu Dharma Parishad, also seeks to impose a ban order on those agitations and processions which are in favour of or against Farmers (Empowerment and Protection) Agreement on Price Assurance and Farm Services Act, 2020 in No.20 of 2020 and farmers produce trade and commerce (Promotion and facilitation) Act, 2020 No.21 of 2020 till the top court takes a decision.
In this context, the plea seeks banning of electronic telecommunications, internet, Facebook, Whatsapp, telegram, posters, flex banner or any other electronic transfer communication regarding any statement or video's of Farmers Acts' related propaganda throughout India.
The plea states that the enactments are pro-farmer and have been enacted in favour of the agriculture.
"That the petitioner states the farmers (Empowerment and Protection) Agreement on Price Assurance and Farm Services Act, 2020 in No.20 of 2020 and farmers produce trade and commerce (Promotion and facilitation) Act, 2020 No.21 of 2020 has been implemented for the interest of agri people and to save them from poverty India is going through an agrarian crisis and the farmers who have been involved in one of the most meaningful livelihoods on earth are struggling to make ends meet," the plea reads.
It is stated that many farmers in the delta regions have committed suicide due to lack of enough water and their fear of inability to save standing crop and the enactments will come to the their rescue.
The organisation points to the fact that the opposition against the enactments have arisen due to political gains,
"That the petitioner states that some states in India are opposing the farmers (Empowerment and Protection) Agreement on Price Assurance and Farm Services Act, 2020 in No.20 of 2020 and farmers produce trade and commerce (Promotion and facilitation) Act, 2020 No.21 of 2020 and resisting to implement the bill in their legislative Assembly for the reason of political gain. It is the bounden duty of state Govts to execute the bill if it is passed in parliaments."
In this backdrop, the plea contends that the the parliament of India has wide power to enact laws and that once, the law is enacted and comes into force, the Central and state Government's Executives shall execute the law. However, some states have decided not to enforce the enactments and inciting people to indulge in riots and arson.
"Everyday there are indulging arson and riot backed by some anti national political parties and threatening the Government to withdraw the bill by using in a terror way if it continues Indian democracy and its power will be only on papers and no one can enforce it. The Government have to use iron hand and they have to quell the riot" - Extract of Plea
The plea has been filed by Advocate Narender Kumar Verma and has been drawn by Baby Devi Bonia.
