Kamat : What is bad in Quran cannot be good in Shariyat - this is how Supreme Court summed it up in triple talaq case. 

Kamat refers to the quote "Islam cannot be Anti-Quran" in triple talaq case. "I rest my case on that", he says.

Kamat : The larger question whether all Quranic injunctions are essential religious practices does not arise in this case. I beseech your lordships to not get into that issue.

Justice Dixit : Whether all Quranic injunctions are inviolable?

Kamat : I would not like to comment on larger issues whether every tenet mentioned in Holy Quran is ERP. For the purpose of this case, hijab is essential.

Justice Dixit :Mr.Kamat, whether what all stated in Quran is essential religious practice?

Kamat : I am not saying that. 

Kamat: If Islamic scriptures of Holy Quran says this practise is obligatory then courts have to permit it. In Shayra Bano case, the Supreme Court held triple talaq practice was not sanctioned by Quran.

The question is not whether a particular religious belief or practice appeals to our reason or sentiment, but whether the belief is genuinely and conscientiously held as part of the profession or practice of religion : Kamat quotes from Bijoe Emmanuel.

Kamat : Core religious practices, if they offend public order, morality and health, they can be regulated under Article 25(1). No religious activities, they can be regulated under Article 25(2).
