    Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheswari and CT Ravikumar will hear the matter today.

    Senior Advocate Kapil Sibal will continue his arguments today on behalf of Zakia Jafri.

    On Tuesday, the Supreme Court heard the closing arguments of the Solicitor General, Mr. Tushar Mehta. At the outset, the Solicitor General was critical of the motivations of Teesta Setalvad (Petitioner No. 2) in the present proceedings, which he argued was to simply malign the State of Gujarat. Apart from that, Mr. Solicitor General, vehemently argued that the State had taken all measures that it possibly could, after the Sabarmati Express was torched and during the ensuing riots. To substantiate his claim, he relied on the Report of the Commission of Enquiries set up by the State with respect to the 2002 riots. In his rebuttal, Mr. Kapil Sibal fervently reiterated his submissions on the lack of investigation by SIT.

      Bench: What was indicated is this your main grievance is that this material has not been investigated at all. We do not have to read that material again and again.

      Sibal: How does this court determine whether there was a larger conspiracy or not.

      Sibal: We are saying otherwise, that you have not relied on the material on larger conspiracy.

      Bench: In Rejoinder you have to point out what best remedy can be available for you. You have not referred to material on larger conspiracy. Local conspiracy has been dealt with, if there is something further to be investigated, point that out.

      Bench: How is the conduct of local police relevant here? That is why investigation was given to SIT.

      Sibal: This Court passed an order to stay the trials, but it never said local admin should not continue investigation in other cases.

      Sibal: Everthing in a chargesheet relied upon by prosecution is ultimately to be proved. Even this tape has to be there, Ashish Khetan has to come to court and the court will decide. Here the SIT has not investigated. They have accepted the statement of accused.

      Sibal: Then, kindly come to, see the last two line of pg. 32. If there is a disclosure statement it is admissible under 25, if there is a denial you cannot rely on it because it is witness statement.
