    Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

     Taking the Court through a range of voluminous documents and notes, Senior Advocate Kapil Sibal concluded his arguments on behalf of the Petitioner yesterday. Senior Advocate Mukul Rohatgi will argue for SIT today,

    On Tuesday, Senior Advocate, Mr. Kapil Sibal appearing for the Petitioner, vehemently argued that the SIT that had given clean chit to the highest functionaries of the State of Gujarat, who were alleged to have been involved in the Gujarat riots of 2002, did not conduct proper investigation and the Magistrate and the Gujarat High Court did not deal with crucial material, refusing to delve further into the matter.

      Rohatgi: These was some other people. She was not there.

      Bench: SLP 4409 and WP (Crl) 216 of 2003 mentioned in last para pertain to which offence? The direction is specific to that.

      Bench: Each case was to be investigated separately.

      Rohatgi: Yes, your lordship. The mantel to SIT given by court is that of a police officer.

      Rohatgi: Last line (order) If any person wants to make statement before SIT giving her/his version SIT should record. SIT gave advertisement in newspapers.Intimate, so SIT can call in. This was limit of SIT originally.

      Rohatgi: Complainant does not go under 190, comes to SC. She wanted FIR against all and sundry. When it comes against her, she files protest which was rejected. Now they say that treat the protest petition as a fresh complaint. Under which law?

      Rohatgi: The limit (of Magistrate) is specific that look at the complaint. Your lordships are sitting under 136. No malafide is and can be alleged against the officers. The Court tells them to go on till the end of trial. That is why Malhotra is still going on till trial ends.
