    The Supreme Court has commenced the final hearing on a petition by Zakia Ahsan Jafri's plea challenging the SIT report giving clean chit to the then Gujarat Chief Minister Narendra Modi and other high functionaries in the Gujarat riots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

    Zakia Jarfi, widow of Congress MLA Ehsan Jafri who was killed in the Gulberg Housing Society massacre during the 2002 Gujarat Riots, has approached the Supreme Court through a special leave petition challenging the SIT report which ruled out any "larger conspiracy" by high state functionaries in instigating the communal riots following the Godhra massacre.

      Sibal - We went to the Magistrate asking for supply of these boxes. 80% of material was supplied. Preliminary enquiry was not supplied. We came to this Court. order passed on 17.01.2013 by this Court. The witness statement was not supplied to us, so we came to court.

      Sibal - 64 boxes of these materials were filed before the Magistrate’s court and in no other cases. Not in Naroda, not even Gulberga. These documents were not filed anywhere

      Sibal : In Naroda Patya case, the man was convicted on the basis of these sting tapes. But qua other cases, these tapes are not considered.

      Sibal : Curfew was declared immediately in Godhra..but in Ahmedabad, curfew was not declared until 12. And thousands of people had gathered by 7 morning. Any police officer would have immediately declared a curfew so that violence could be avoided.

      Sibal : There has to be an investigation. That is all our case about. If there is no investigation, what was the purpose of the Supreme Court constituting the SIT?

      Sibal : With the greatest respect, no court, whether it is the Magistrate, High Court or Supreme Court can come to a conclusion whether there was conspiracy or not without an investigation.

      Sibal : Then there is state intelligence report..that the Kar Sevaks who were returning were carrying Trishuls and there was communal tension.

      Sibal : Testimony of Sreekumar(then Gujarat ADGP) was rejected by the SIT on the ground that he was denied promotion.. his testimony was corroborated by other officers and hence it could not have been rejected..

      Sibal says that tapes suggested conspiracy to smuggle dynamite bombs to Ahmedabad from quarry operated by a VHP worker. These aspects not investigated by the SIT, Sibal says.
