CJI: A counsel submitted that so far as reservations for OBC was concerned, since they won't get it in creamy layer, they're considered in Open.
So you're reserving only for those who aren't in (4)& (5) so for OBCs above creamy layer, the cake will be cut into 40% from 50%.

This 10% is independent of the 50% compartment so far as the OBCs, SCs and STs are concerned

AG: There is a duty cast on State by the Directive Principles and Art 46. A new innovation was embarked upon to meet needs of directives and mandate contained in the preamble of the Constitution as well as 46 & 47.

AG: Yesterday, I had submitted that 10% reserved for the EWS in General Category cannot be added to the 50% limit. It is only if you add to the 50% reserved with the backward classes, the limit will arise.
