Former Attorney General for India and Senior Advocate KK Venugopal has written to the President of the Supreme Court Bar Association Vikas Singh advising him to not allow the passing of the resolutions proposed against Senior Advocates Kapil Sibal and Neeraj Kishan Kaul.
The SCBA General Body meeting is scheduled to consider tomorrow(March 16) the resolutions proposed against Sibal and Kaul for tendering apology to the Chief Justice of India on behalf of the bar for the outbursts made by Senior Advocate Vikas Singh while seeking urgent listing of a petition filed by the SCBA in relation to lawyers' chambers.
A section of the bar took exception to the conduct of Sibal and Kaul and proposed passing resolutions to reprimand them. Later, another section of the bar wrote a letter against the proposed resolutions by warning that the SCBA will be setting a "dangerous precedent" if lawyers are called into question for their submissions made in the court room.
In this backdrop, the former AG chose to write a separate letter to Singh cautioning him that if the resolutions are passed, it will lead to divisions within the bar and could "permanently sour the the peaceful relationship that exists today among bar members". He said that he believed that the apology made by Sibal and Kaul was to maintain the cordial relationship between the bar and the bench.
"I would therefore sincerely request you not to allow these two resolutions so that this event may not explode into a situation where there may be two camps with enmity between the members inter se, which may not be conducive to the peace and well-being of Supreme Court Bar Association," he said in his letter while mentioning that he has been a President of the SCBA on three occasions.
The two resolutions referred to in the AG's letter are :
- Issue appropriate Show Cause Notice to the concerned members(Sibal & Kaul) as mentioned in the resolution demanding their explanation; and
- Any mentioning done by a member of the Bar to belittle the stand taken by the SCBA in the Judicial proceeding should be highly condemned and in the future strict action be taken against such member.
