The Supreme Court has been moved in a PIL challenging the constitutionality of Rule 6(1) of the Indian Police Service ( Cadre) Rules, 1954 for conferring powers on the Central government to override the states in matters of transfer and deputation of IPS cadre officers.
Further, it has been pressed that there is a dichotomy between Rule 5(1) and Rule 6(1). Rule 5(1) requires allocation of officers to the various cadres to be made by the Central Government in consultation with the State Government or concerned by concurrence.
However, as per Rule 6 (1), in case of any disagreement in the matter. the issue shall come to be decided by the Central government and the State government is bound to give effect to the decision of the Central Government, it is submitted.
