    The Supreme Court will hear today the case concerning the air pollution crisis in Delhi.

    A bench comprising Justice Abhay S Oka and Augustine George Masih will hear the matter (MC Mehta v. Union of India).

    On Monday, the Court directed CAQM to consider relaxing restrictions on physical classes in schools under GRAP IV measures. The Court also directed CAQM to prosecute authorities which failed to enforce ban on truck entry in Delhi.

      Order: We continue the appointment of the court commissioners. We accept the suggestion by the court commissioners that the Transport department of Delhi government will appoint a Nodal Officer for the purposes of facilitating the work by the court commissioners.

      We clarify that as far a stage 4 of GRAP is concerned, the ban on entry of truck traffic into Delhi except the following categories -

      1. Trucks carrying essential commodities.

      2. Trucks providing essential services.

      3. All LNG, CNG, electric, BSVI diesel trucks.

      There is no other exception admissible under clause 1 of stage 4.

      Therefore if any authority has issued any instruction which runs contrary to above, the same will not bind the police and other staff posted at the entry points.

      Order: List on Monday end of the list.

      In terms of paragraph 5 of our last order, the Commission will issue necessary directions consisting of mitigating measures as suggested by us. Learned ASG states that clarification issued by the director technical of the commission dated 28 November 2024 will be withdrawn.

      Order: our attention is invited to an article appearing in India Today of 27th November 2024 which records that an officer and others admitted that they are advising the farmers to burn the struggle after 4:00 p.m. to avoid satellite detection.

      We are not on the correctness of this news but if it is correct it is very serious.

      The state officials cannot permit any farmer to take advantage of the fact that at present activities are being detected which take place during few hours of the day. The government should immediately issue instructions to all officers not to indulge in any such activities.

      Order: the suggestions with reasons shall be placed before the court on Monday.

      We are informed that our direction in terms of paragraph 4 of order dated 25th September 2024 has not been implemented by any of the NCR States. We direct compliance to be made with the same direction at the earliest and in any case on or before Monday.

      Order: we make it clear that all GRAP IV measures except the measures which are modified in respect of the schools will continue to operate till Monday. In the meantime the commission will hold a meeting and come out with the suggestion about moving from GRAP IV to GRAP III or GRAP II. We also make it clear that it is not necessary that all measures which are provided in GRAP IV should be dispensed with. there can be a combination of measures in GRAP III and GRAP II.#SupremeCourt #DelhiAirPollution

      Order: The immediate issue which needs to be addressed is that the trucks are allowed to enter the limits of Delhi and then after travelling some distance they are taking a u-turn back to from where they have arrived. This issue also needs to be addressed.

      Order: we have taken a glance at the second report by the court commissioners. The first report indicates that there is abject failure of various authorities to implement GRAP IV measures in its letter and spirit. There are violations pointed out in both the reports.

      We expect states to make a statement before us about the action they propose to take in case of breaches which are specifically pointed out by the commissioners.

      J Oka: we want you to tell us that some other cities also this issue will have to be taken up.. better to be taken up by the supreme court. Right now throughout December will give grappling with these emergency situations. So let us have regular detailed hearings in January Issue wise. And we want to hear from other states also on Monday.
