    The Lok Sabha is at present considering three criminal law bills.

    The bills are Bharatiya Nyaya (Second) Sanhita, Bharatiya Nagarik Suraksha (Second) Sanhita and Bharatiya Sakshya Bill, which seek to repeal and replace the Indian Penal Code 1860, Code of Criminal Procedure 1973 and the Indian Evidence Act 1872.

    The bills were initially introduced by Home Minister Amit Shah in the Monsoon Session and were referred to a Parliamentary Standing Committee. The initial bills were withdrawn and were re-introduced during this session, incorporating certain suggestions made by the Committee. Home Minister Amit Shah said that most of the changes from the first versions are grammatical in nature.

    It may be noted that several key opposition members were suspended from the Lok Sabha today. 49 INDIA bloc MPs were suspended from the Lok Sabha today. 33 Lok Sabha MPs & 45 Rajya Sabha MPs from the Opposition were suspended from the Parliament on December 18, 2023. 13 Lok Sabha MPs & 1 Rajya Sabha MP were suspended earlier on December 14, 2023 for the remainder of the Winter Session for “gross misconduct”.

      Ravi Shankar Prasad: While the IPC focused on punishment, the proposed Bharatiya Nyaya Sanhita focuses on nyaya, i.e., justice. CrPC prescribed a procedure to penalise accused, but Bharatiya Nagararik Suraksha Sanhita proposes to safeguard the rights of the accused.

      Adoption of Bharatiya Nyaya Sanhita Bill and shift away from IPC would create a more unified, equitable, and responsible legal framework for allaying social concerns. It's a progressive and cohesive replacement of an outdated penal code.
