A plea has been filed before the Supreme Court seeking directions for cancellation of Class X and XII Board Examinations, 2021 in the State of Assam.

Further directions have been sought to the State Government, Assam Higher Secondary Education Council and Board of Secondary Education, Assam ('SEBA') to arrive at a formula for performance evaluation of the Students of Assam in line with the formula adopted by CBSE and other Education Boards and to release the results in a time bound manner.

The requests have been made through an intervention application filed on behalf of Students of Assam who are due to appear in Xth and XIIth State Board Examinations 2021, in the petition filed earlier before the Apex Court for cancellation of CBSE and ICSE exams (Advocate Mamta Sharma vs Union of India).

The present application has sought directions to State Government, SEBA and AHSEC to allow students to file their objections within a reasonable period of time, in case they are not satisfied with the results so published.

Further directions have also beens sought to conduct an examination after normalisation of the situation and to allow the students to appear therein, for all such students who will file their objections with reference to the results.

The applicants have argued that it would be unjust, unfair and unreasonable to allow the State Government to conduct Board Examination, 2021 and will have an adverse effect on the both the future of the students, and also of the State of Assam.

"In the present case the State Government without ascertaining the condition of the students with respect to their social wellbeing, is trying to impose the Board Examination on them, which, under the given facts and circumstance, is not going to be a fair way of evaluating the students." the application reads

Referring to public statements made by Ministers, State's Officials and the Chief Minister expressing their willingness to conduct XII and X Board Exams, the applicants have stated that it has created a situation of havoc amongst the students, pushed them into a state of dilemma and has devastated their mental condition.

The present application has been filed by Advocate Manju Jetley and drawn by Advocates Prabhu Prasanna Behera, Abhishek Choudhary, Nabab Singh, Ritika Ritu, and Abhishek Patnaik.
