    In a recent order, the Supreme Court has clarified that the registration of all BS VI Compliant diesel vehicles is allowed to be done in NCT Delhi, irrespective of their requirement for the G-20 summit.

    The bench of Justice Sanjay Kishan Kaul and Justice Sudhanshu Dhulia said, “From a reading of the order it does appear that the order has been passed in the aforesaid terms but learned Amicus Curiae submits that the registration as per directions passed earlier did not relate to the BS VI vehicles and thus all such vehicles may be registered.”

    “In view of the aforesaid, we modify the order dated 15.05.2023 to permit registration of all such vehicles,” it added.

    On May 15, the Court had said that prayer made is for directions to registering authorities to register BS VI compliant diesel vehicles having seating capacity of more than 7 plus 1 persons, coaches and buses which are stated to be required for the G-20 Summit.

    Noting that the Amicus Curiae submitted that there was “no impediment to the requirement of registration as the directions passed earlier by NGT did not relate to BS VI vehicles,” the Court said, “the prayer as made is allowed.”

    However, a subsequent application was filed wherein the applicants stated that “the prayer was not confined to G20 events alone.” It was only for the purpose of the urgency towards the listing that the upcoming G20 event was mentioned during the mentioning, it submitted

    Background

    In April, Indian Tourists Transporters Association filed an application stating that RTO in New Delhi was not permitting registration of BS VI compliant diesel vehicles having seating capacity of more than 7 plus 1 persons, coaches & buses etc.

    The applicant highlighted that the decision of RTO in NCT Delhi in disallowing the registration of BS VI diesel compliant diesel has failed to rely upon any executive or judicial order and statutory provision to support their action.

    It was also pointed out that all such similar vehicles were being registered all over NCR and the same are operating in Delhi.

    Therefore, the Association members who are based in Delhi are suffering great prejudice and discrimination with respect to their vehicles being disallowed from registration and the RTOs in NCT Delhi, stated the applicant.
