Guruswamy: I have also attached, unlike the state, multiple studies with strong methodology as well as other constitutional court decisions such as South Africa, Brazil on same sex couples to adopt, to parent, to be treated as a family and given dignity.

Dr Menaka Guruswamy: I am responding specifically on submissions of same sex parenting and adoption rights of same sex couples argued yesterday by NCPCR. I do so on behalf of DCPCR.

Kothari: When under SMA, transgender persons can come and marry after gender reassignment, we're asking for the right to be extended to all.

Kothari: The debates show that even SMA was law for freedom of choice in marriage and reading in would be required for a constitutional framework.

Kothari: SMA did not exclude any person even in 1954 irrespective of faith and caste and it was based on constitutional principles.

Sr Adv Jayna Kothari: An argument was made that any kind of reading into the SMA would go against the core of the legislation. I want to submit that the core of the SMA is that it moved away from the sacramental nature to its contractual nature.
