Tripura High Court Directs State Police To Take Steps To Recover 16-Yr-Old Girl Allegedly Kidnapped & Taken To Bangladesh

While dealing with a habeas plea for recovery of a minor daughter (16 year old) of the petitioner who was allegedly kidnapped and taken to Bangladesh, the Tripura High Court directed the Tripura police department to ensure her recovery at the earliest.
The Bench of Chief Justice Indrajit Mahanty and Justice S. G. Chattopadhyay further authorized the police authorities to make a request to the Indian High Commission at Bangladesh to take follow-up action with the concerned police station and take all necessary steps to assist the Bangladesh police authorities in effecting recovery of the minor.
Further, listing the matter on 14th December 2021, the Court called for a further status report and in the event, the minor girl is located in the meantime, the Court added, she shall be produced before the Magistrate Court and her statement under Section 164 Cr. P.C shall also be recorded.
Essentially, the Court was dealing with a petition filed by a father of the minor girl, seeking the issuance of a writ of habeas corpus for the recovery of her minor daughter.
It was submitted before the Court that the girl was kidnapped on September 8, 2021, and a criminal case had been registered in the West Agartala Women Police Station under Sections 366-A, 212, 109, and 34 of IPC.
The Court perused the progress report of investigation in the matter and found from the detailed report that various steps have been taken to locate the missing child.
The Court also noted that in course of the investigation, the IO had ascertained that the alleged victim has been taken to Bangladesh and necessary steps have been taken by the police authorities with their counterparts in Bangladesh to take necessary steps for the speedy recovery of the alleged victim
Against this backdrop, the Court prima facie observed that the alleged victim appeared to be a minor and, therefore, the Court added, it was essential that all steps be taken for ensuring her recovery at the earliest.
