The Bench of Chief Justice Hima Kohli and Justice B. Vijaysen Reddy issued a notice to the State of Telangana directing it to file a counter-affidavit within four weeks.
Significantly, the Court ordered that till further orders, no funds shall be released in terms of the Government order
The Court was hearing the plea of one Prabhakar Chouti challenging the impugned Government Order as illegal, arbitrary, unconstitutional and against the principles of natural justice and to set aside the same.
It was also prayed that Respondents be directed to not act upon the G.O and to restore the amount if any paid to Respondent No. 4 for the Contempt Cases.
The Government order sanctioned ₹58,95,63,000 towards fighting contempt cases pending in the High Court.
Staying the operation of the order, the Court has posted the matter for further hearing on October 27.
